Terms of Service
 

1. Introduction
1.1. These Terms of Service (“Terms”) govern your access to and use of the website located at https://aapkasahyog.com/ (the “Platform”) and related services provided by AapkaSahyog (“we”, “us”, “our”).
1.2. By using or accessing the Platform in any way (visiting, browsing, registering, making contributions, creating campaigns, or using any features), you agree to be bound by and comply with these Terms. If you do not agree with these Terms (or any future amendments), you must immediately discontinue use of the Platform.
1.3. We reserve the right to modify or update these Terms from time to time. We will provide notice (e.g. via email, in-platform announcements, or posting changes on the website). Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

2. Definitions
For clarity, the following capitalized terms will have these meanings:

  • “User” means any person or legal entity accessing or using the Platform, including Donors, Campaign Creators, Visitors.

  • “Donor” means a User who contributes funds or other support to a campaign.

  • “Campaign Creator” means a User who sets up or runs a fundraising or donation campaign on the Platform.

  • “Campaign” means a fundraising or donation initiative created by a Campaign Creator on the Platform.

  • “Contribution” means the actual donation, payment, pledge, or funds provided by a Donor to a Campaign.

  • “Fees” means any service fees, platform fees, payment processing fees, or charges we are entitled to collect in connection with use of the Platform.

  • “Content” means text, images, audio, video, files, links, data, or other materials posted, uploaded, submitted, or otherwise made available via the Platform by you or other Users.

3. Eligibility; Registration
3.1. You must be at least 18 years old (or the legal age in your jurisdiction) and capable of forming binding contracts to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
3.2. You may be required to register an account (the “Account”) to use certain features (e.g. to create a campaign, make a contribution, comment, upload content). You agree to provide true, accurate, current, and complete information at registration and maintain and promptly update your information.
3.3. You are responsible for maintaining the confidentiality of your login credentials (username, password, two-factor authentication, etc.). You are fully responsible for all activities that occur under your Account. Notify us immediately at anjorfoundation@gmail.com. if you suspect unauthorized access or a breach of security.
3.4. We may refuse registration or suspend or terminate your Account at any time for any reason (for example, breach of these Terms, suspected fraud, or as required by law).

4. Campaign Creation & Management
4.1. A Campaign Creator can create one or more Campaigns by providing required information: title, description, goal amount, images, promotional media, timeline, use of funds, reporting plan, etc.
4.2. All Campaigns must comply with our campaign guidelines, policies, and applicable law. You may not run a Campaign for any illegal purpose, prohibited cause, or otherwise fraudulent scheme.
4.3. You must clearly and truthfully describe the purpose, use of funds, beneficiaries, risks, and other relevant details in your Campaign. Misrepresentation or false claims are strictly prohibited.
4.4. You authorize us to publish your Campaign, solicit Contributions, display progress, donor names (if permitted), updates, and communications to donors.
4.5. Once a Campaign is live, the Campaign Creator should actively update donors, report on progress, and use funds as promised.
4.6. Campaign Creators must comply with all local regulations (tax, charity registration, financial laws, etc.) applicable to fundraising in their jurisdiction.

5. Contributions & Payments
5.1. Donors may make Contributions to Campaigns using the payment methods supported by the Platform (credit card, debit card, wallets, net banking, UPI, etc.).
5.2. By making a Contribution, you authorize us (or our payment processors) to charge your chosen payment method for the amount of the Contribution and applicable fees.
5.3. Contributions are generally non-refundable except in limited circumstances (see our Refund & Cancellation Policy).
5.4. We may impose a minimum or maximum Contribution amount at our discretion.
5.5. We may verify donor identity or payment method, delay disbursement of funds, or refuse a Contribution if we suspect fraud, violation of these Terms, payment issues, or legal concerns.
5.6. We are not a financial institution, trustee, or escrow agent. Until disbursed to the Campaign Creator (minus fees), Contributions may be held in an account managed by us (or our payment providers) in accordance with applicable laws and to the extent necessary to facilitate the Platform.

6. Fees; Disbursements; Payment Processing
6.1. We charge Fees in return for providing the Platform and payment processing services. Our Fee structure (platform fee, payment processing fee, commission, etc.) is published in our Fees & Pricing page or policy.
6.2. The Campaign Creator authorizes us to deduct our Fees from Contributions before disbursal.
6.3. Payment processors, banks or intermediaries may also charge fees (interchange, gateway fees, currency conversion, etc.). Those are separate and in addition to our platform Fees.
6.4. We will disburse net funds to the Campaign Creator’s designated bank account or payment account, subject to verification, delay, holds, or reserves as we deem necessary to manage risk, compliance, or fraud prevention.
6.5. Disbursement schedules (e.g., frequency, thresholds, minimums, delay periods) will be specified in our policies and may differ by currency, country, or campaign type.
6.6. We may withhold or reverse disbursements if a Campaign is found in violation, or if refunds are demanded, or for legal compliance.

7. Refunds, Cancellations & Chargebacks
7.1. Contributions are final and non-refundable, except in cases expressly permitted by us or as required by law.
7.2. If a Campaign fails to meet its goal (if applicable) or is canceled by the Campaign Creator before disbursement, we may refund donors (in whole or in part), minus non-recoverable payment processing fees.
7.3. If a donor disputes a charge (a “chargeback”) with their bank or card issuer, we may attempt to recover funds from the Campaign Creator or donor, and may suspend further use of the Platform pending resolution.
7.4. If a Campaign is canceled or terminated by us due to violation of these Terms, we may refund donors (if possible) or decide whether funds should remain with the Campaign or be returned, at our discretion.
7.5. Any refunds, cancellations, or disputes will be handled in accordance with applicable laws, banking rules, and our internal policies.

8. User Content; Grant of Rights
8.1. You retain ownership of any Content you submit, upload, post, or display on or through the Platform.
8.2. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, translate, adapt, publish, distribute, publicly perform, publicly display, and promote such Content as part of operating the Platform (e.g. display your campaign page, donor messages, updates, social sharing).
8.3. You represent and warrant that:
a) You own or control all rights to the Content and have the lawful right to grant the license above;
b) The Content does not infringe any third party’s copyright, trademark, privacy, publicity, or other proprietary rights;
c) The Content complies with all rules, policies, and applicable laws (no libel, defamation, hate speech, illegal content, etc.).
8.4. We reserve the right (but are not obligated) to refuse, remove, reject, or block any Content at any time, including Content that violates these Terms, is inappropriate, or for any other reason.
8.5. If you believe your Content has been wrongly removed or that your rights have been infringed, contact us at anjorfoundation@gmail.com. to submit a notice.

9. Prohibited Conduct / Use Restrictions
You agree not to:
9.1. Use the Platform for any purpose that is illegal or prohibited by applicable laws.
9.2. Create or fund campaigns involving violence, terrorism, illegal drugs, weapons, adult content, gambling (unless expressly permitted), pyramid or Ponzi schemes, misleading or fraudulent causes, or any prohibited or regulated activity.
9.3. Submit false, misleading, or fraudulent information about Campaigns, beneficiaries, use of funds, or your identity.
9.4. Use bots, scrapers, crawlers, or automated means to access, harvest, or index data from the Platform without prior written permission.
9.5. Interfere with or disrupt the security, integrity, or performance of the Platform or servers, or introduce malicious software, viruses, worms, or other harmful code.
9.6. Attempt to gain unauthorized access to other users’ accounts, data, or private areas of the Platform.
9.7. Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
9.8. Use the Platform to send unsolicited promotional or marketing messages (spam) to other users.
9.9. Engage in any activity that imposes an unreasonable or disproportionately large burden on our infrastructure.
9.10. Copy, reproduce, modify, create derivative works of, reverse engineer, decompile, or otherwise attempt to derive source code from our software or APIs (except as explicitly permitted).

10. Privacy & Data Protection
10.1. Use of personal data is governed by our Privacy Policy (which should be available on the website).
10.2. We collect, store, process, and use personal information (e.g. name, email, address, payment info, usage data) in order to provide the Platform services, process contributions, comply with laws, support users, detect fraud, and improve our services.
10.3. We may share or disclose personal data with payment processors, banks, third-party service providers, audits, legal or regulatory authorities, or as required by law.
10.4. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security; you acknowledge that there is inherent risk in transmitting information online.

11. Disclaimers & Limitation of Liability
11.1. No Guarantee / “As Is” — The Platform, services, Content, and all related materials are provided on an “as is” and “as available” basis. We make no warranties or representations, express or implied, of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.
11.2. We do not guarantee the success of any Campaign, the reliability of any donor, or the actions of any third party.
11.3. We are not a party to any agreement between Donors and Campaign Creators; we merely provide the Platform as a facilitator.
11.4. In no event shall we (or our officers, directors, employees, contractors, agents) be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of goodwill, business interruption, or lost data, even if we have been advised of such potential damages.
11.5. In no event shall our total cumulative liability to you, whether in contract, tort (including negligence), or otherwise, exceed the total amount of Fees paid by you to us in the preceding 12 months (if any), or otherwise a low fixed cap as allowed by law.
11.6. Some jurisdictions do not allow disclaimers or limitations of liability for certain damages; in such case, those limitations may not apply to you.

12. Indemnification
You agree to indemnify, defend, and hold harmless AapkaSahyog, its affiliates, officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way related to:
a) your use or misuse of the Platform;
b) your Content;
c) your violation of these Terms;
d) your violation of any law or rights of third parties;
e) your failure to perform obligations under these Terms.

13. Termination; Suspension; Account Closure
13.1. Either you or we may terminate or suspend your access to the Platform or certain features (in whole or part), at any time, for any reason (with or without notice).
13.2. If you terminate your Account, you remain responsible for outstanding obligations, pending contributions, or claims incurred before termination.
13.3. We may retain certain information (including Content, financial records, logs) after termination to comply with legal obligations, enforce these Terms, prevent fraud, or resolve disputes.
13.4. Sections that by their nature should survive termination (e.g. indemnification, limitation of liability, dispute resolution, governing law) will survive.

14. Dispute Resolution; Governing Law
14.1. These Terms are governed by and construed in accordance with the laws of the Republic of India (or the relevant state), without regard to conflict of laws principles.
14.2. Any dispute, controversy or claim arising out of or relating to these Terms, your use of the Platform, or any transactions shall first be attempted to be resolved through good faith negotiation between you and us.
14.3. If negotiation fails within 30 days, either party may bring the dispute to binding arbitration (or alternative dispute resolution) in a location agreed by both parties.
14.4. If arbitration is not enforceable or applicable, the courts in [State / City], India, shall have exclusive jurisdiction.
14.5. You agree that any claims must be brought within one (1) year after the cause of action arises; otherwise, they are barred.

15. Notices
15.1. All notices under these Terms must be in writing and delivered to the respective email addresses (for example, anjorfoundation@gmail.com. for us, and the email you provide for you).
15.2. Notices are deemed delivered upon receipt (if via email), or five (5) days after mailing (if via postal service).

16. Intellectual Property
16.1. The Platform (software, website design, text, graphics, logos, icons, trademarks, service marks) is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.
16.2. You may not copy, reproduce, modify, publicly display, distribute, or create derivative works of the Platform or underlying technology, except as explicitly permitted.
16.3. If you believe any content on the Platform infringes intellectual property rights, you may send a DMCA or equivalent notice to anjorfoundation@gmail.com. with sufficient detail.

17. Modifications to the Platform
17.1. We reserve the right to modify, suspend, discontinue, or restrict access (temporarily or permanently) to all or any part of the Platform, its features, or services, with or without notice.
17.2. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Platform or services.

18. Third-Party Services; Links
18.1. The Platform may contain links to third-party sites, services, or APIs, or integrate third-party services (payment gateways, social media, analytics). We do not control such third parties, and are not responsible for their content, practices, or terms.
18.2. Your use of third-party services is subject to their terms and policies.
18.3. Inclusion of links does not imply endorsement or warranty of such third parties.

19. Electronic Communications & Consent
19.1. By using the Platform, you consent to receive electronic communications from us (email, in-platform messages, push notifications).
19.2. These communications may include notices about your Account, updates, changes to Terms or policies, promotional materials, and other information.
19.3. You may opt-out of promotional communications (where permitted) by following unsubscribe instructions, but critical service notices may still be delivered.

20. Representations & Warranties by Users
You represent and warrant that:
a) You have full power and authority to enter into these Terms and perform obligations;
b) Your use of the Platform and Content will comply with these Terms and all applicable laws, regulations, rules, and policies;
c) You are not barred or restricted from using crowdfunding or donation platforms in your jurisdiction;
d) Any payment method you use is valid, belongs to you or you are authorized to use it, and is not fraudulent or stolen.

21. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable under applicable law, such provision will be struck or modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

22. Waiver
No waiver by us of any breach or right under these Terms shall be deemed a waiver of any other breach or right, unless in writing and signed by an authorized representative.

23. Assignment; Transfer
23.1. You may not assign, delegate, or transfer your rights or obligations under these Terms to another person without our prior written consent.
23.2. We may freely assign or transfer our rights or obligations (e.g. through merger, acquisition, corporate restructuring) without your consent; such assignment will be binding upon you.

24. Force Majeure
We will not be liable for any delay or failure in performance if due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, government acts, strikes, power failures, internet outages, or any other cause beyond our reasonable control.

25. Feedback; Suggestions
If you provide us with suggestions, feedback, or ideas regarding the Platform (e.g. new features, enhancements), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, implement, distribute, or otherwise exploit such feedback without restriction or compensation to you.

26. Entire Agreement
These Terms (together with any policies referenced herein, e.g. Privacy Policy, Fees & Pricing, Refund Policy) constitute the entire agreement between you and us regarding your use of the Platform, and supersede all prior or contemporaneous agreements, communications, and proposals (oral or written) relating to such subject matter.

27. Miscellaneous
27.1. Headings in these Terms are for convenience only and have no legal effect.
27.2. Any ambiguity in interpretation will not be construed against the drafting party.
27.3. You agree that these Terms, policies, notices, and your consent to do business electronically satisfy any legal requirement that such communications be in writing.
